I started this new job recently at an independently owned deli. I used to work at a grocery store deli, so the way things are run are a LOT different. When I worked at the grocery store for 7.5 hours, say, I got 2 paid 15 minute breaks, plus an unpaid 30 lunch. But today I worked 10 hours at the new place, and only got an unpaid 30 minute lunch. I know the grocery store was over-compensating, but shouldn't I get more than one half-hour when I work TEN hours? This is what the Ontario Employment Act says, but I'm not sure how to interpret it:

Quote:
An employee must not work more than five consecutive hours without getting a 30-minute eating period free from work.

Technically, though, I worked from 9 until about 6:45. The store closes at 6, and we're there until everything is finished and clean, but the schedule said 9-7.

Hmm. I think that would mean if you work more than five hours you should get a thirty minute lunch?

I would think that if you worked ten hours you would get more breaks though, at least another two coffee breaks I would say.

At my work, if you work a 4 hour shift you get a paid 15 min coffee break. If you work 6.5, you get one paid coffee break and one unpaid 30 min lunch break. And if you work 8.5 hours, you get two paid coffee breaks and one unpaid 30 min lunch...I dunno if that helps though.

you did not get one 15min break because you were paid 15mins, and you got to go home early.
like at my work some people either work the same amount and get paid 15 mins extra (like you did), or they leave 15mins early and still get paid their original amount.
i think you should ask, it does no harm to you

I think you should get more breaks.

At Starbucks, I get a 15-minute paid for up to 5.5 hours, if I work between 5.5 and 8 I get an unpaid half and a paid 15, and if I work 8 or more I get two paid 15s and an unpaid half.

I know that people normally get more than the legally required amount, but this is a small independent store (not like Starbucks or a big chain grocery store where they have that luxury). I dunno, I think it's pretty ridiculous, though. Hopefully I just won't be scheduled for a 10-hour shift again. I've seen people working 12-hour shifts get 2 unpaid 30-minute lunches.

At Tim Horton's I got a 15 paid break for working 4 hours, or 2 paid 15 min breaks for working over 6 hours. 10 hours shifts got you 3, I think. Nobody worked those so I'm not sure about that.

wooo i get unpaid 30 break! thats it =[
if i work 6 hours or less, depending on who's manager that day, i dont always take a break. if its slow i can if i want to, but i usually don't.

did you have a break at 2pm? cuase if you did that would be them stretching it since you technically didnt work over 5 hours without a break. could you not request one, since tahts a very long work day ? ><

^on Sunday, when I worked this really long shift, I asked the owner how long my break was, and he said a half-hour, and then I said, even though I'm working from 9-7? And he said yes. One half-hour. And this was at about 4 o'clock, because it was busy up until then.

Maybe you should show him what it says in the Ontario Employment Act. I dunno, but maybe it'll help.

I don't take 15 minute breaks at my work, and no one really does. I feel guilty if I do. Mainly because I'm pretty sure my break's in there somewhere since when it's quiet I don't really do much. I know I should, but I don't really need to.

Also when I work 4-930 on the rare occasion I don't take a dinner..that's 5.5 hours...and I just eat before and when I get home. I don't really mind and that's what most people do.
