Replacing iPod?

So I bought an iPod nano 3rd gen. in January and now it's having some problems. The scroll on it isn't working properly. I don't even have to touch the pad and it will start scrolling. Hovering over the menu part makes it move up/down randomly.
So I want to get this fixed/exchange for a new one but I don't know what I have to do.
The store I bought it from doesn't except returns of opened packages, so I'm guessing I have to deal with Apple?
Suggestions of what I should do??

Ugh, that sucks!
My old one used to just freeze all the time.

Before calling them or anything, email them and tell them your problem. Usually companies are pretty good about emails. Usually under "Contact Us" on the bottom of a web page, there is an email option. Good luck with this!

I actually ended up fixing it. I just had to push down the wheel while rotating around. I think maybe something was out of line? If that works? But I'll remember to email them if it happens again.
